Current Rates in Tamil Nadu (2025)

Tamil Nadu's stamp duty and registration charges as of 2025:

**Stamp duty:** 7% of the registered value (guideline value or actual sale value, whichever is higher)

**Registration fee:** 1% of the registered value (capped at ₹30,000 for some transaction types — check with SRO for your specific category)

**Combined:** Effectively 8% of property value added to your purchase cost.

Example: For a ₹25 lakh plot, stamp duty = ₹1.75 lakhs, registration fee = ₹25,000. Total additional cost: ₹2 lakhs. Always include this in your total budget calculation.

What "Registered Value" Means

The registered value is the higher of: 1. The actual sale consideration (what you're paying) 2. The guideline value (the government's minimum reference value, set sub-registrar office-wise and updated periodically)

If you try to register a ₹25 lakh property at ₹15 lakhs to save stamp duty, the SRO will calculate stamp duty on the guideline value (say ₹20 lakhs) — and you'll have committed tax under-declaration, which is a separate legal risk.

How Guideline Value Is Set

Each sub-registrar office maintains a guideline value list by area (village, ward, survey number range). This is a published schedule. You can check guideline values at: https://guideline.tnreginet.gov.in

The guideline value is typically 60–80% of market value in active markets, sometimes lower in slower markets.

Registration Process: Step by Step

1. Prepare the sale deed (drafted by a lawyer) 2. Calculate stamp duty on guideline value or actual price (whichever higher) 3. Buy non-judicial stamp paper or use e-stamping (TNSP website) 4. Book an appointment at the sub-registrar's office online (tnreginet.gov.in) 5. Both parties appear with two witnesses each, original IDs 6. SRO clerk reviews document, collects fees 7. Document scanned, registered, document number issued 8. Collect the original registered document (same day or within 2 days)

Is There a Legal Way to Reduce Stamp Duty?

Short answer: No significant reduction in Tamil Nadu, unlike some states that offer rebates for women buyers or first-time buyers. Tamil Nadu's 7% is a flat rate.

What you can legitimately do: Negotiate the property price itself (lower base = lower stamp duty in absolute terms). Understand the guideline value before entering negotiations — if guideline value is well below your price, the savings from negotiating below market are compounded.

Gift Deed: Lower Stamp Duty

Transfers between close relatives (parent-child, siblings) can be done by Gift Deed at reduced stamp duty (1–4% vs 7% for sales). However, Gift Deeds are not sales — they don't generate cash to the transferor. Use Gift Deeds for estate planning and intrafamily transfers, not for commercial property purchases.
